Theft, Robbery, Burglary And Other Property-Related Charges

In Montana, property-related criminal charges can be broken down and summarized in the following manner:

  • Theft: A person purposely or knowingly obtains or exerts unauthorized control over property of the owner or obtains control over stolen property, knowing the property to have been stolen by another.
  • Robbery: A person, in the course of committing theft, inflicts bodily injury on another, threatens to do so, purposely or knowingly puts another in fear of immediate bodily injury, or commits or threatens to commit any felony other than theft.
  • Burglary: A person knowingly enters or remains unlawfully (i.e. not licensed, invited or otherwise privileged to do so) in an occupied structure (any building, vehicle or other place suitable for human occupancy), or night lodging of persons, or carries on business whether or not a person is actually present with the purpose to commit an offense therein.
  • Forgery: A person knowingly makes or alters a document or other object apparently capable of being used to defraud another, or possesses forged documents with the purpose of issuance or use, or delivers documents known to be forged.
  • Arson: A person knowingly or purposely, by means of fire or explosives, damages or destroys an occupied structure that is the property of another without consent, or places another person in danger of death or bodily injury.
